Terms of Service

These are the General Terms of Service applicable to all services provided by CyberServe . By using our services, including managed cloud servers, dedicated machines, and scalable virtual environments, you ("the Subscriber" or "Client") agree to comply with and be bound by the following terms and conditions.

The use of any service contracted with CyberServe presupposes complete acceptance of these conditions. If you do not agree with these terms, please do not use our services.

1. Acceptable Use of Services

All services contracted with CyberServe must be used exclusively for lawful purposes. It is strictly prohibited to use any of our services in a manner that violates any local, national, or international law.

2. Service Suspension and Cancellation

CyberServe reserves the right to refuse, suspend, or cancel services contracted by the Subscriber with or without prior notice if the Subscriber engages in conduct or activity that CyberServe considers abuse or violation of any terms, rules, and conditions herein.

This includes cases where our Technical team cancels services to accounts that prevent the correct operation of other users. Each suspension case will be evaluated individually, and administrative discharge will be handled accordingly.

Fraud Prevention

CyberServe may request additional information to validate customer accounts and may use third-party anti-fraud services (such as MaxMind) to assess customer behavior. We may retain customer payments for up to 30 business days for customers classified as high-risk or who fail to validate their account through proper identification.

3. Software, Scripts, and Applications

Subscribers may install and execute scripts and applications on their servers. However, CyberServe reserves the right to deactivate any script or software installed by the Subscriber that affects the normal operation of servers or harms other clients.

Any software or application installed on CyberServe servers (shared, VPS, or dedicated) must have the corresponding license to endorse usage rights. In case of a license verification request by the software owner, the service will be suspended until the user presents proper permissions.

Resource Limits

Accounts found to be consuming excessive CPU, RAM, or disk I/O resources may be throttled or suspended. Subscribers will be notified and given options to upgrade to appropriate plans.

4. Bandwidth and Data Transfer

All hosting plans include a specified amount of monthly bandwidth. If you exceed the transfer limit, you will be notified via email. Repeated exceeding of bandwidth limits may result in:

5. File Distribution and Storage

Websites whose primary purpose is file distribution and storage (e.g., photo galleries, MP3 libraries, video archives, large compressed files) will be evaluated on a case-by-case basis.

CyberServe reserves the right to suspend or cancel such accounts. A site may be considered file distribution if more than 5% of its content is dedicated to downloadable archives.

Files exceeding 100MB in size may be removed without prior notice to maintain server stability. For large file storage, clients must upgrade to VPS or dedicated server plans.

6. Email Policies

Anti-SPAM Policy

The Subscriber undertakes not to transmit unsolicited advertising (SPAM) through email or any other means. This applies to services hosted with CyberServe or any other provider advertising our services.

SPAM Violations: If SPAM email is detected from a user account, the account will be immediately suspended and a $50 reactivation fee will be charged. Continued violations will result in permanent account termination without refund.

Exceeding these limits will result in temporary blocking of outgoing mail until the next hour cycle.

Bulk Email

Mass mailing is not permitted on shared hosting plans as it affects server performance. If you need to send bulk emails, contact our technical team at cyberserveuser@proton.me for guidance and alternative solutions.

7. Anti-Phishing Policy

CyberServe supports international organizations in the fight against phishing. "Phishing" involves obtaining information to commit fraud or identity theft through deceptive practices.

8. Service Contracts and Billing

Payment Terms

All services are billed in advance on a monthly, quarterly, or annual basis as specified in your plan. Once you request a plan and receive purchase confirmation, you have 30 days to complete payment.

After payment is made, you must notify us through your client area to activate or renew services. Payment notification does not guarantee immediate verification—status can be checked in your client area after the estimated processing time.

Service Cancellation

To cancel a service, the customer must request and confirm cancellation from the client panel. Failure to cancel properly while the service remains active allows CyberServe to take necessary collection actions.

Late Payments and Service Expiration

If payment is not received by the expiration date:

Once data is deleted, CyberServe is not responsible for data recovery and the user loses all rights to claim deleted information.

9. Data Backup and Loss

CyberServe is not responsible for data loss caused by users, system failures, server updates, or other unforeseen circumstances. It is the user's responsibility to maintain backup copies of all data.

While CyberServe performs regular backups, we do not guarantee backup availability or completeness. Backups are not performed for accounts exceeding 35GB in size.

Backup restoration requests will incur a $50 service fee for the work required to complete the task.

10. Domain Registration and Management

Domain Registration

Domain registration is subject to availability at the time of processing with the corresponding registrar. This process begins only after payment verification. Once a domain is registered, its characters cannot be modified and the amount paid cannot be refunded.

By registering a domain through CyberServe , you accept the terms and conditions established by ICANN and the respective domain registry.

Domain Renewal

Only domains initially registered through CyberServe will be renewed. Domains registered elsewhere must be transferred to us at least 30 days before expiration.

Domain Transfer

Domain transfer is a courtesy service provided to customers. CyberServe is not responsible for transfer completion as it depends on the releasing registrar. There are no refunds for transfer fees once the process begins.

It is the client's responsibility to verify that the domain is in Active/OK status and to provide the transfer authorization code.

11. Money-Back Guarantee

A refund may be requested within the first 30 days of service activation for eligible plans only, subject to the following conditions:

Non-refundable items: SSL certificates, licenses, domain registrations, domain renewals, domain transfers, and payments made through certain payment gateways.

Refunds may take up to 90 business days to process.

12. Server Migrations

Migration of the first 15 cPanel accounts from another hosting provider is free of charge, provided the previous host uses cPanel and offers full backup functionality.

Migration timeframe: 3-10 business days depending on technical team availability. Migrations are performed Monday through Friday; weekend migrations require prior arrangement.

Additional migrations beyond 15 accounts may incur fees. Non-cPanel migrations are evaluated individually and may require additional charges.

13. Service Modifications

CyberServe reserves the right to modify the characteristics and prices of plans and services offered. Technical changes will be communicated through our website, and continued use of services implies acceptance of modifications.

14. Limitation of Liability

CyberServe shall not be liable for:

Our total liability shall not exceed the amount paid for services in the preceding 12 months.

15. Confidentiality and Data Protection

CyberServe maintains the confidentiality and security of information provided by Subscribers as described in our Privacy Policy. We comply with applicable data protection laws including GDPR.

Support response times vary by plan level. Premium and dedicated server plans receive priority support.

17. Reseller Responsibilities

CyberServe does not have contractual relationships with end customers who contract services through resellers. Resellers are responsible for their customer relationships and support.

Resellers must comply with all terms and conditions and are liable for the actions of their customers.

18. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the competent courts in the United States.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms of Service, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and CyberServe regarding the use of our services.
